  • Refusing to break the law at an employer’s request

  • Discrimination based on age, race, national origin, gender, disability, medical condition, religion, pregnancy, sexual orientation, or other protected classes

  • Retaliation for reporting or complaining about unlawful discrimination or harassment (including sexual harassment)

  • Retaliation for whistleblowing on violations of workplace safety laws, wage-and-hour laws, or other legal violations

  • Taking medical leave, such as disability leave under the Family and Medical Leave Act (FMLA) or the California Family Rights Act (CFRA)

  • Requesting reasonable accommodations for a disability

  • Reporting employer misconduct, such as fraud, to government agencies (whistleblowing)

Forced Resignation & Constructive Discharge

 

Wrongful termination does not always require a formal firing. If your employer creates intolerable working conditions, forcing you to resign, the law may consider this a “constructive discharge”, which is treated as wrongful termination.
