PREGNANCY RIGHTS

Halavi Law, Inc. Protects the Rights of Pregnant Workers

Pregnant employees in California are protected under state and federal laws that prohibit discrimination, retaliation, and wrongful termination due to pregnancy, childbirth, or related medical conditions. Employers are required to provide reasonable accommodations, protected leave, and a discrimination-free workplace for pregnant employees.

If your employer has denied your rights, refused accommodations, retaliated against you, or terminated you because of your pregnancy, you may have a legal claim. Halavi Law, Inc. is committed to protecting the rights of pregnant workers and ensuring they receive the fair treatment and protections they deserve.

Your Legal Rights as a Pregnant Employee

Pregnant workers are protected under:

  • California Pregnancy Disability Leave (PDL)

  • Fair Employment and Housing Act (FEHA)

  • Family and Medical Leave Act (FMLA)

  • California Family Rights Act (CFRA)

  • Americans with Disabilities Act (ADA)

These laws provide the following protections:

1. Protection Against Pregnancy Discrimination

Employers cannot:

✔ Fire or demote you for being pregnant

✔ Refuse to hire you because of pregnancy

✔ Retaliate against you for requesting accommodations or leave

✔ Deny you the same opportunities, promotions, or benefits as other employees

2. Reasonable Accommodations for Pregnant Employees

Employers must provide reasonable accommodations if you need adjustments due to pregnancy or a related medical condition. This may include:

✔ Modifications to job duties

✔ More frequent breaks

✔ Temporary transfer to a less strenuous position

✔ Remote work or a modified work schedule

✔ Additional time to sit or stand as needed

3. Pregnancy Disability Leave (PDL) & Parental Leave

Employees may be eligible for:

✔ Up to four months of Pregnancy Disability Leave (PDL) for pregnancy-related conditions

✔ Up to 12 weeks of baby bonding leave under CFRA if your employer has five or more employees

✔ Job protection during leave, meaning your employer must reinstate you to your job or an equivalent position when you return

4. Paid & Unpaid Leave Benefits

Depending on your situation, you may also qualify for:

✔ State Disability Insurance (SDI) for pregnancy-related medical leave

✔ Paid Family Leave (PFL) for bonding with your newborn

✔ Paid sick leave for pregnancy-related medical needs
