MEAL AND REST BREAKS
Halavi Law, Inc. Recovers Penalties for Missed Meal and Rest Breaks
Every worker deserves proper breaks during their workday. California labor laws guarantee most employees the right to rest breaks and at least one meal break during their shifts. Unfortunately, many employers ignore these laws, unlawfully denying workers their legally mandated breaks.
If your employer has failed to provide meal or rest breaks, you may be entitled to compensation. It is also illegal for your employer to retaliate against you for filing a complaint regarding missed breaks.
Meal Breaks
Under California law, hourly employees typically cannot work more than five hours per day without receiving an uninterrupted 30-minute meal break. While some exceptions apply, meal breaks must follow these legal requirements:
-
The first meal break must occur before the end of the fifth hour of work.
-
Employees must be fully relieved of duties during the break.
-
Employees may leave the worksite during their meal period.
-
Employees working more than 10 hours per day may be entitled to a second meal break.
Rest Breaks
In addition to meal breaks, employers must provide paid rest breaks based on hours worked. These rest breaks must meet the following conditions:
-
Employees earn a 10-minute break for every four hours worked.
-
Rest breaks must be fully duty-free and taken in the middle of the work period.
-
Rest periods must be paid as normal working hours.
